The United States Patent and Trademark Office (USPTO) registration examination, more commonly referred to as the “patent bar,” is the test that one must pass to be eligible to practice before the USPTO. Individuals that pass the examination are referred to as either a “patent attorney” or a “patent agent.” A patent attorney successfully passes the patent bar exam and is a member of the bar of at least one state. A patent agent is not a member of a state bar but has passed the patent bar exam. It is unnecessary to hold a law degree to become a patent agent. The computer-delivered patent bar examinations include 100 multiple-choice questions, only ninety of which will be scored. To pass the examination a candidate must correctly answer seventy percent (or sixty-three) of the ninety scored questions. Ten of the questions on the examination will be undergoing beta testing. The ten beta test questions will not be identified and will not be scored. The examination is administered by Prometric, a company that operates a test center network comprised of over 3,000 sites in 135 countries. Although you are not allowed to bring materials in with you while taking the examination, you will have the ability to search the entire Manual of Patent Examining Procedure (“MPEP”) by chapter. However, you should not overly rely on this search functionality. If you learn the information in this guide, you can pass the test with minimal searching.
